In re DVI, Inc. Sec. Litig., 2:03-cv-5336 (E.D. Pa): Final Approval of Partial Settlements in Securities Fraud Action

On November 9, 2006, the United States District Court for the Eastern District of Pennsylvania, the Honorable Legrome D. Davis, approved a partial settlement of claims asserted against three defendants in this case. The three settling defendants, OnCure Medical Corp., Dolphin Medical, Inc. and PresGar Imaging LC, are referred to in the case as "Special Relationship Entities" ("SREs"). The SREs were alleged to have engaged in a scheme, in violation of s10(b) and Rule 10b-5 (a) and (c), to conceal for DVI substantial impairments in certain loan and lease assets recorded on DVI's books. The terms of the settlement provide a $2,885,000 cash payment from these defendants to the Class. The Class comprises all purchasers of DVI, Inc. common stock and 9 7/8% Senior Notes, who purchased those securities from and including August 10, 1999 through August 13, 2003. A copy of the the Court's order approving the settlement is provided here. Notices and Claim Forms regarding the Settlement were mailed on or about September 1, 2006, and must be filed with the Claims Administrator on or before January 3, 2007.
