"Korshak" Retiree Healthcare Litigation:
Retiree Healthcare (the Korshak/Underwood litigation for all City of Chicago annuitants): In litigation dating back to 1987 the City, on May 15, 2013, declared its intention to phase out and end retiree healthcare entirely by the end of 2016.
We launched the current challenge to that in late 2013. The case was removed to federal court, dismissed, but reversed and remanded to the Circuit Court of Cook County, Illinois.
Currently pending in the Illinois Appellate Court are our requests for a preliminary injunction and audit/reconciliation of charges for the last half of 2013.
On January 13, 2016, we filed the Third Amended Complaint, asserting claims for lifetime protection under the Constitution's Art. XIII, Section 5 Pension Protection Clause, as well as Breach of Contract and Estoppel. The City and Funds' trustees moved to dismiss the complaint.
On Janyary 21, 2016, Circuit Court Judge Cohen issued his ruling upholding the Constitutional claim for protection of benefits for those hired prior to 8/23/1989.
On November 22, 2016 we filed our Opening Appellate Brief. On November 23, 2016, we filed an Emergency Motion for Injunction Pendente Lite, Against City and Funds' December 31, 2016 Termination of Retiree Healthcare Benefits (Action Required by December 1, 2016)
The case is being actively pursued to fight for your promised lifetime retiree healthcare benefits.
