On May 21, 2014 and June 2, 2014, Judge Neil H. Cohen of the Circuit Court of Cook County, Illinois preliminarily approved certification of a settlement class and preliminarily approved settlement of gratuity claims and Illinois wage hour claims in the matter titled Dahnka, et al. v. Wrigley Rooftops III, et al., Case No. 2012-CH-37196, and set July 29, 2014 for a hearing on final approval of the settlements. Anyone who was employed by Wrigley Rooftops III, LLC, d/b/a Wrigley Field Rooftop Club; Wrigley Rooftops IV, LLC d/b/a Sheffield Baseball Club; the Ivy Leage Club, or by Thomas Gramatis, owner of the aforementioned rooftop venues ("Defendants") during the calendar years 2008 through 2012 (with respect to the gratuity claim), from 2010 through 2011 (with respect to the overtime wage & hour claim) and 2012 (with respect to the unpaid lunch break wage & hour claim) may be entitled to a recovery.
Specifically,

those who worked for Defendants at least 7.5 hours during any given day during the 2012 calendar year and had an automatic 1/2 hour lunch deduction taken out of their paycheck are entitled to recover the amount of the deduction, plus interest.

Those who worked for Defendants at least 35 hours during any given week during the 2010 and 2011 calendar years are entitled to a pro rata share of a fund allocated to ensure overtime was properly paid to employees during that period.

And those who were hourly employees (except administrative or office workers) during 2008 through 2012 will receive a prorate portion of a fund (based on hours worked during that period) to compensate them for unpaid gratuity collected by Defendants.
To participate in the settlements you must submit a claim form to Class Counsel by July 16, 2014. A copy of the claim form can be obtained below, along with a copy of the Notice mailed to class members and the Publication Notice included in the Chicago Sun-Times.
